3. Orders and Customers
All orders at TyreX are processed as soon as reasonably possible, assuming you place your order on a business day. When placing an order, you accept TyreX's General Terms and Conditions and confirm that you are:
- A resident of New Zealand;
- Legally authorised to make purchases with the selected payment account; and
- Ordering Products to be delivered and/or fitted in New Zealand.
If any of the above is incorrect, please do not place an order with this site. We reserve the right, in our sole discretion and at any time, to refuse, reject, or cancel any order placed with us.
Referral discounts and promotional programs offered by TyreX apply only to orders placed directly on www.tyrex.co.nz. Orders placed through partner platforms or third-party websites are not eligible for referral discounts or rewards unless otherwise stated.
4. Prices
All our prices include GST and any other applicable taxes (charged at the current rate shown on the website). Prices include delivery unless otherwise stated on the website. Prices are given in New Zealand dollars (NZD). We reserve the right to correct mistakes and update information without prior notice. However, if an incorrect price has been shown on a product you have already ordered, we will notify you and await your approval of the correct price before we process your order.
4.1 Price Match and Promotional Discount Limitations
Price match approvals are not valid in conjunction with any other promotional offers, voucher codes, referral credits, or additional discounts. Any order placed in breach of this condition may be cancelled or amended by TyreX prior to fulfilment.
4.2 TyreX Tyre Price Match Guarantee
TyreX strives to offer customers the best possible price on tyres. If you find a competitor with a cheaper price on an identical item, TyreX will beat that price by 3%, subject to the following terms and conditions.
Eligibility Criteria
- 4.2.1. Proof of the competitor's tyre price must be provided in the form of a written quote, printed advertisement, online listing, or other verifiable documentation. The competitor must have a valid New Zealand Business Number (NZBN). This price will be verified with the competitor before acceptance of the price match.
- 4.2.2. Price match requests must be submitted before placing an order on TyreX.
- 4.2.3. The tyre must be in stock and available for delivery at the time of the price match request from both TyreX and the competitor.
- 4.2.4. Price comparisons apply to the tyre product only and exclude any additional fees (e.g., shipping or fitting).
- 4.2.5. Price match approvals are final and cannot be combined with any other offer, including voucher codes, promotional discounts, or referral credits. Any order placed in breach of this condition may be cancelled or adjusted at TyreX's discretion.
- 4.2.6. The tyre must be identical to the one offered by TyreX, including brand, model, condition, and an age of no more than 4 years.
- 4.2.7. Limit of one price match per customer.
- 4.2.8. Offer valid for retail customers only. Wholesale, trade buyers, importers, and deal/coupon sites are excluded.
- 4.2.9. Price match does not apply to competitor liquidation or aged stock sales.
- 4.2.10. The competitor's price must not be part of a special offer, promotion, loyalty reward, coupon, cashback, or similar deal.
- 4.2.11. The competitor must stock the tyre locally — quotes from businesses in a different region to the customer may not qualify.
- 4.2.12. Price match requests must be made prior to purchase and are not retroactive.
- 4.2.13. TyreX will only match prices from verified or well-known retailers, including major retail chains with established online stores, official brand websites or authorised dealers, and trusted e-commerce platforms known for reliability and service.
Exclusions
TyreX will not match a competitor's price if:
- 4.2.14. The product is already part of a TyreX order.
- 4.2.15. The competitor's price includes discounts from promotions, loyalty rewards, coupons, cashback, or similar.
- 4.2.16. The competitor listing is from a classified site such as Trade Me or Facebook Marketplace.
- 4.2.17. The price is the result of a technical error on the competitor's side.
- 4.2.18. The product is not a tyre.
- 4.2.19. The quote is not from a verified retailer (see clause 4.2.13).
- 4.2.20. The price is no longer available or valid at the time of the request.
5. Payment
5.1 TyreX offers a range of payment methods as shown at checkout, which may include credit/debit card, PayPal, and buy-now-pay-later services. We reserve the right not to offer all payment methods at all times. By submitting a credit or debit card number, you: (a) confirm that your use of the particular card is authorised and that all information you submit is true and accurate; and (b) authorise us to charge the card you provide for all amounts payable by you to us (including GST and any other applicable taxes) based on the items you order.
5.2 If we suspect that any order is fraudulent or involves stolen identity or payment information, we reserve the right to make additional authenticity checks and to involve any authorities we deem appropriate.
5.3 Buy-now-pay-later payment methods are offered and controlled by third-party providers. We simply offer them as a payment option; any issues or queries regarding instalments should be directed to the relevant provider.
6. Warranties and Guarantees
6.1 Any warranties provided by TyreX and listed on this website apply in addition to any other rights to which you may be entitled under the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Our liability to you under this agreement is otherwise limited as set out in clause 7.
6.2 Our goods and services come with guarantees that cannot be excluded under New Zealand consumer law. For major failures with a service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods.
6.3 If a failure with goods or a service does not amount to a major failure, you are entitled to have the failure rectified within a reasonable time. If this is not done, you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion.
6.4 You are also entitled to be compensated for any other reasonably foreseeable loss or damage resulting from a failure in the goods or service.
6.5 TyreX Manufacturer's Guarantee
All products purchased at TyreX carry a 1-year warranty against faults or defects resulting from manufacturing. Damage caused by use in competition or racing, during fitting, disassembly, or balancing, or any improper use of the products, is not covered by this warranty. Some brands may offer an extended manufacturer's warranty beyond the standard 1 year — where this applies, it will be stated on the relevant product listing.
For any warranty claim, the buyer must first return the tyres for inspection to determine whether the issue is due to a manufacturing fault. If the inspection confirms a manufacturing issue, compensation will be assessed based on the remaining tread of the tyres, and resolved by way of a replacement or partial refund, determined after inspection.
This Guarantee applies in addition to any other rights you have under the consumer guarantee provisions of the Consumer Guarantees Act 1993. Please see clauses 6 and 7 of these Terms and Conditions for further detail.
7. Liability
7.1 Without excluding, restricting, or modifying the rights and remedies to which you may be entitled under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or TyreX's obligations under those Acts:
- You acknowledge that this website is provided "as is" and that we do not make any warranty or representation as to the suitability of this website or a product for any purpose;
- We exclude all other implied terms and warranties, whether statutory or otherwise, relating to the website or the subject matter of this agreement; and
- We will not be liable to you for indirect and consequential loss arising from or connected to this agreement in contract, tort, under any statute, or otherwise (including, without limitation, loss of revenue, loss of profits, failure to realise expected profits or savings, loss or corruption of data, and any other commercial or economic loss of any kind), unless such loss arises as a result of our own negligence or wilful misconduct.
7.2 Our liability to you for loss or damage of any kind arising out of this agreement, or in connection with the relationship established by it, is reduced to the extent (if any) that you cause or contribute to the loss or damage. This reduction applies whether our liability is in contract, tort (including negligence), under any statute, or otherwise.
8. Delivery
8.1 Products purchased at TyreX can be delivered to: (1) your address; (2) your chosen fitting partner, if available; or (3) another given address.
8.2 Products are usually delivered within 3–5 business days from the time the product leaves the warehouse, unless stated otherwise. Due to unforeseen changes in demand, shipping times can fluctuate. We aim to notify you if we suspect we cannot make delivery within the estimated time, but, to the extent permitted by law, we shall not be liable to you for any losses, liabilities, costs, damages, charges, or expenses arising out of late delivery.
8.3 Delivery costs are based on the delivery address and tyre size. These costs will be added to the total order price, which will be visible in the cart and can be calculated on the product detail page.
8.4 Where you select a fitting service through TyreX, the advertised fitting price is inclusive of tyre fitting, balancing, and disposal of old tyres where applicable. The fitting price is a bundled service fee, and no partial refunds or credits apply where any component of the service is not used.
9. Cancellation Notice
If you request to cancel your order prior to shipment, a cancellation fee of $25 NZD will be payable to cover courier cancellation fees and processing charges.
In the case of wheels/rims orders, a cancellation can only be accepted if the wheels have not already been prepared for shipment. Once dispatched, no returns can be offered.
10. Refunds and Returns
You are entitled to request a return within 14 days of the delivery date.
To initiate a return, please email office@magwheelrepair.co.nz with your name, order number, and reason for return. Our team will guide you through the next steps in line with the claims process outlined in clause 11.
Returns are accepted for:
- Change of mind;
- Incorrectly ordered products; and
- Other approved cases at TyreX's discretion.
Only unused tyres that have not been fitted or mounted onto a vehicle are eligible for return. Tyres must be in original, resalable condition.
If collection is arranged by TyreX, tyres must be available at the agreed location and time. If collection cannot be completed as scheduled, additional charges may apply.
Return shipping is at the customer's cost unless agreed otherwise. A restocking fee of up to 15% of the total order value may apply.
Once the returned tyres are received and inspected, we will process your refund (excluding freight costs) within 14 days. Refunds will be issued to the original payment method, unless otherwise agreed.
To the extent permitted by law, associated costs (such as rental vehicles) are not reimbursed.
This policy may be updated from time to time. For any questions, please contact office@magwheelrepair.co.nz.
11. Claims Process
For all goods or services claims, please send an email to office@magwheelrepair.co.nz with your name, order number, and reason for return to request a return authorisation. Once a claim is approved, payment processing may take up to 10 business days.
TyreX will send you the claims forms and return delivery details you need. For approved claims, the customer will have the products replaced with an equivalent product and be reimbursed for any additional agreed expenses.
TyreX will determine whether your claim is eligible for remedy under the Consumer Guarantees Act 1993 or any additional guarantees or warranties set out on this website.
If the claim is not approved, delivery costs are not refunded and the customer is fully charged. The customer is responsible for the products until they have been received by TyreX. Please ensure products are packed carefully so they are not damaged in transit.
12. Ownership Reservation
All products remain the property of TyreX until full payment has been received.
13. Product Information and Disclaimers
13.1 Product Availability. The products on our website are for sale; however, we reserve the right to make changes. If typographical errors, technical problems, or similar issues occur, we reserve the right to cancel affected orders. If this happens, you will be contacted.
13.2 Supplier Descriptions. Product descriptions are primarily provided by our suppliers. While we strive for accuracy, TyreX accepts no responsibility for discrepancies in these descriptions.
13.3 Wheels or Rims. Tyres are sold without wheels or rims, which are available as separate products where offered. Images displaying wheels or rims are for illustrative purposes only and are not included in the price or purchase of a tyre unless explicitly stated.
13.4 Image Accuracy. Product images may sometimes differ from the actual product — for instance, tread patterns or other design elements may vary. TyreX accepts no responsibility for variations between product images and the actual products.
13.5 Customer Responsibility. TyreX accepts no responsibility for any tyre equipment, including wheels or rims, that you, as a vehicle owner, choose to use with your vehicle.
14. Fitting and Installation Services
14.1 Where TyreX or an affiliated partner provides tyre fitting, wheel repair, or related installation services, these services are subject to availability and may be booked separately from your tyre purchase.
14.2 Fitting appointments should be attended at the agreed time. TyreX reserves the right to charge a reasonable rebooking or late cancellation fee where an appointment is missed without reasonable notice.
14.3 Any pre-existing damage to a vehicle, wheel, or rim identified prior to fitting will be brought to the customer's attention. TyreX is not liable for pre-existing damage or wear.
14.4 Wheel repair services are quoted separately and are subject to inspection of the wheel prior to confirmation of final price.
15. Force Majeure
We are not responsible for delays caused by events beyond our reasonable control (Force Majeure), including but not limited to natural disasters, war, strikes, decisions from authorities, non-delivery from suppliers, and other circumstances that could not reasonably have been foreseen. Where such events occur and make TyreX unable to fulfil an agreement or commitment, TyreX will be released from the obligation to fulfil that agreement or commitment for the duration of the event.
16. Changes to These General Terms and Conditions
We reserve the right to update and make changes to these General Terms and Conditions. Any changes or additions will be published at tyrex.co.nz. Continued use of our website is considered acceptance of any changes.
17. Declaration of Invalidity
If any clause of these General Terms and Conditions, or of an agreement, is declared invalid or unenforceable by a court, the remaining parts of the General Terms and Conditions remain valid. Any clause held invalid or unenforceable will be replaced with appropriate guidance consistent with the original intent, to the extent permitted by law.
18. Website Restrictions
No program or automated technology may be used to browse, search, share, or download text, images, or code from this website without our prior written consent.
19. Privacy Policy
Please read our Privacy Policy, which forms part of these General Terms and Conditions. It is available on our website.
20. Age of Tyres
The majority of tyres we offer are manufactured within 12–24 months of your purchase date. As with any physical retailer, some sizes and brands may have older manufacturing dates, as tyres are purchased and imported in batches from suppliers and not all sizes sell as quickly as others. We will endeavour to check with customers if the tyre available is more than 4 years since production.
If a tyre is over 4 years of age, it will be priced accordingly. If stock is marked as 'Clearance stock', the tyres may have an age greater than 4 years or may be demonstration tyres.
21. Clearance Tyres
Products marked as clearance have been discounted and may include discontinued product lines, take-off tyres, and products older than TyreX's recommended manufacturing date of 4 years. All clearance tyres are unused/new products.
Condition Disclaimer
While all clearance tyres are unused/new products, some may have been used for demonstration purposes or may have minor cosmetic imperfections. TyreX makes every effort to ensure clearance tyres are in good condition, but customers should be aware that clearance tyres may have been mounted on rims or used for display purposes.
Additional Information
If you are unsure about the condition of a particular clearance tyre or would like additional information, please contact our support team before purchase to avoid delays or unnecessary return fees.
Return Policy
Clearance tyres are subject to the same return policy as regular tyres. Customers should carefully inspect clearance tyres upon delivery and report any issues or discrepancies to our support team promptly.
Limited Availability
Clearance tyres are available in limited quantities and may be subject to availability. Prices and availability of clearance tyres are subject to change without notice.
Warranty
Clearance tyres are covered by TyreX's standard warranty policy, which provides protection against manufacturing defects. For more information, please refer to clause 6 (Warranties and Guarantees) of these terms and conditions.
22. Tyres Left at Fitting Stations
If a customer is unreachable for one month or more after tyres have been delivered to a fitting station, the customer forfeits the tyres and may not be entitled to a refund.
23. Images
Images are for illustration purposes only. Wheel rims are not included with the tyre, and actual tread may differ from images depicted.
24. Inappropriate or Rude Behaviour to Staff
If you, a fitting partner, or any other individual involved with TyreX or the purchase of tyres behaves inappropriately or rudely towards staff, you will forfeit all additional privileges, promotions, and services other than the basic purchase and delivery of tyres at full retail price.
25. Trademark Acknowledgments
All product names, logos, and brands displayed on this website are the property of their respective owners. TyreX uses these trademarks solely to identify and describe products and services. The use of these trademarks does not imply endorsement, affiliation, or sponsorship by the trademark owners, unless explicitly stated.
